1. Basic terms and conditions:
1.1. User - an individual, a visitor to the sites svoy-ts.ru and sys.svoy-ts.ru, who joins this Agreement voluntarily and in his own interests, or is its representative on the basis of the current legislation of the Russian Federation.
1.2. Svoy TS is an Internet site hosted in the svoy-ts.ru domain and its subdomains.
1.3. Administration - Limited Liability Company "Svoy Tourist Service" (PSRN 5147746284318, INN / KPP 7730715332/773001001, legal address: Russian Federation, 121165, Moscow, Kievskaya street, building 22, building 1, floor 1 room 103)
1.4. Service - a set of services provided by Svoy TS (selection of an active tour, telephone consultations, e-mail distribution of commercial offers and newsletters);
1.5. Agreement - this agreement with all additions and changes.
1.6. Application - the user provides his contact information (name, phone number, e-mail address), in order to receive the service from the Administration.
2. General provisions of this Agreement
2.1. In accordance with Art. 437 and 438 of the Civil Code of the Russian Federation The user is recognized as having accepted the terms of this Agreement and entered into a contractual relationship with the Administration after completing an application on the administration website.
2.2. The Administration processes the User's personal data in accordance with the Federal Law "On Personal Data" No. 152.
2.3. This Agreement enters into force from the moment the User expresses his consent to the specified conditions and is valid until the Agreement is withdrawn.
2.4. This Agreement can be changed by the Administration unilaterally without prior notice to the Users. The new version of the Agreement comes into force from the moment it is posted on the site svoy-ts.ru.
3. Subject of the agreement
3.1. The administration provides the Svoy TS user with a service: services for the selection of an active tour, provides telephone consultations and sends commercial offers and newsletters by e-mail.
3.2. To receive the service, the user clicks on the "Book seats" button on the website and issues an application for the selection of an active tour.
3.3. By providing his contact information in the application, the user agrees to the use of his contact information by the Administration.
3.4. By checking the box "I accept the terms of the User Agreement", the user accepts the terms of this agreement and confirms his agreement with this Agreement. At the same time, the User's consent is expressed freely, by his own will and in his interest in full, without any reservations or exceptions, is specific and conscious, emanating directly from the User. If the User does not agree to use the Service under the terms of this Agreement, the User undertakes to immediately stop using the Service.
3.5. Upon receipt of an application from a user, the Administration uses the personal data specified in it to communicate with the user.
3.6. In order to provide the service, the Administration may transfer the user's personal data to third parties (organizers of active tours).
4. Obligations of the User
4.1. By accepting the terms of this Agreement, the User acknowledges and guarantees the following provisions.
4.2. The user provides the Administration with his own personal data with their consent. The user is obliged to obtain consent from third parties for the transfer of their personal data before the actual transfer of such data to the Administration.
4.3. The user, by joining the terms of this Agreement, gives this written consent to the automated processing of the provided personal data in order to receive the Service from the Administration.
4.4. The user consents to the transfer of personal data (in accordance with clause 4.2. Of the Agreement) to third parties (organizers of active tours) in order to fully provide the Service.
5. Copyright
5.1. The performer is not the author of the tours and photographs presented on the site svoy-ts.ru. The authors of the tours and photographs are Tour Operators with whom the Contractor has entered into agreements for the implementation of tours.
5.2. Tour operators provide the Contractor with text descriptions and photos for the tours, which the Contractor posts on the site svoy-ts.ru.
5.3. If the Contractor receives information about copyright infringement in the use of photographs or other materials posted on the site, the Contractor deletes this information at the first request of the author.
6. Other conditions
6.1. This Agreement, after its acceptance by the User in accordance with the rules of sections 2 and 3 of this Agreement, acquires the status of an official agreement between the User and the Administrations. In this case, all previous agreements between the Parties become invalid.
6.2. The publication (placement) of this Agreement is a public offer (offer) of the Administration, addressed to a wide range of persons in order to provide information services.
6.3. The fact confirming the conclusion of a public contract on the part of the consumer of services is his consent, indicated by the User in electronic form when accepting the offer by affixing a confirmation sign in the field "I accept the terms of the User Agreement" and which is an analogue of the user's handwritten signature. A public contract made in the above procedure is recognized by the Parties as actually and legally concluded in a simple written form, does not require subsequent execution in paper form and has full legal force.
6.4. This Agreement, the procedure for its conclusion, execution, interpretation, as well as issues not regulated by this Agreement are subject to resolution in accordance with the legislation of the Russian Federation.
6.5. The invalidity of any clause of this Agreement does not entail its invalidity as a whole.
6.6. Nothing in this Agreement can be considered as the establishment of a legal relationship of an agent, partnership, joint activity, personal employment or other relationship not expressly provided for in this Agreement.
6.7. This Agreement may be changed or terminated by the Site Administration unilaterally without prior notice to the User and without payment of any compensation in this regard.
6.8. This version of the Agreement may be provided to the User for review in another language. In this case, the Russian version of the Agreement shall prevail for interpretation.
